Am I eligible for California Pregnancy Leave Act?

My employer is located in another state but I work from home in California. I am the only employee they have in California. The California pregnancy leave act states that it applies to employers with more than 5 employees – is that more than 5 employees located in the state of California, or more than 5 employees period? Thanks!

California law does not apply to companies that do not have a physical building in California.
